Protecting Your Financial Information in Child Support Disputes: Illinois Law
QuestionHi - my husband's exwife makes 5 times more money than my husband and has been suing to triple the child support he pays her. Since his income isn't very much, she is suing for my financial records. I live in Illinois - is there anyway that I can protect myself from her greed short of divorcing my husband?

She can try to sue for your financial records all she wants. She's legally not entitled to view them nor does she have any business knowing what your income is. You have absolutely NO financial responsibility and/or legal right to those children, period. And she's can NOT go by your financial income to raise his child support amount. You aren't legally responsible for his CS, etc. So they can't go after you nor your financial records. A judge will see this and deny her access to your financial records, etc. You are legally protected from anything by state laws for cases just like this. There are laws in all 50 states that abide by these laws protecting spouses not being responsible for child support, etc. If that makes any sense whatsoever. So she can sue you for anything she likes, the simple fact is that a person in the USA can sue for anything they'd like (if they can come up with a reason, then they can sue for it), but that doesn't mean she'll make any progress or headway in this matter and in fact she won't. If she's going to do this, you may be interested in retaining an attorney to protect yourself from her. She's doing this b/c she thinks she has a right to do this (which, again she has no legal leg to stand on at all) but she's trying anyway. Ignore her and her pathetic attempts to get at your and her ex-husband. Any judge (that's smart and knows the law) will clearly see that she's doing this just out of spite and greed and will throw this case out of court.
