Marriage Breakdown: Can I Force My Husband to Leave the Family Home in the UK?

Question
Although living in the same house my husband has ignored me for two weeks, he communicates through the children. The weird thing is I dont think I care anymore. What I need to know is, I dont think he will leave the house voluntary, as the children will live with me 8yrs and 13yrs can I make him leave?

Answer
Hi Tracy~

If the UK is anything like the US (where I'm from) you probably can't kick him out of the marital home.  The only way you'd be able to do that is through a court order forcing him to leave and find another place to reside.  The reason being is that in the US (and UK might be similar) is that the courts see it as marital property and one can't be forced out of his/her own home by their spouse (again unless there is a court order saying otherwise), b/c it protects both parties.  So unless/until one is willing to vacate the marital property you can't force him to leave and vice versa.  He also needs to stop communicating through the children.  As this is an adult matter, and you don't give adult duties to children.  The children already have enough to deal with in trying to cope with their parents not getting along, they should just try to enjoy being children w/o having adult responsibilities to begin with.  I hope this helps you some.
