Divorce & Co-habitation: Legal Implications of Moving In During Separation

Good Morning,

My question is; generally speaking how do you think it would look to the court if husband and wife are divorcing, she refuses to move out so the parenting plan is basically obsolete, and he has a girlfriend whom he is considering moving in with.....while still legally married.  That is the main question moving in while still married?

Hi Michelle,

I think that it would look strange that someone could not wait to at least to get all the divorce issues out of the way. I don't know if it is so much the court as public opinion that I would worry about.  What about the children?  How would they see this?  One has to think about the consequences to others as much as to oneself when making decisions.
