Protecting Your Assets in a Second Marriage: Spousal Support & Ex-Spouse Claims

Question
I just read a responce you gave a reader about getting remarried and whether or not his new wifes money could be touched by his ex-wife. I am in a similiar situation. I would like to marry a man who is divorced and his ex-wife has their children. I live in Maine and want to know if what you told the other gentleman is true for all states. Can she not go after my money? Is there a law somewhere that states this? My boyfriend is extremely worried about this. Thank you for all of your help.

Amy

Answer
Hi Amy~

Yes, it's very true, in all states.  The ex-wife can NOT include your income for child support, period.  No ifs, ands or buts about it.  They go solely by the income of the father of the children.  As it's considered his (the bio-father and bio-mother) children and not the spouses income (did you know that step parents do not have any legal rights to the step children, unless of course they are adopted legally by them).  So you both have absolutely nothing to worry about.
