Marriage License Waiver: Can You Get a License Before the 30-Day Waiting Period?

My fiance received his final divorce decree notice on February 22nd 2007, we were planning on waiting the 30 days before getting a marriage licence. My parents have said that they are flying to the States (they live in the UK) before the 30 days and I would really like them to be at my wedding. We have been told that we can get a waiver for the Judge to sign allowing us to get a licence before the 30 days is up. Do you know if that is the case and how we go about obtaining this waiver? Is there a special form?

Hi Tina~

Generally in a divorce, you must wait the alotted 30 days before legally being allowed to remarry.  It's required by law for many reasons.  I've never heard of a waiver being signed by a judge before the 30 day waiting period.  In fact I've honestly never heard of this (I'm not saying this isn't true though, I'm just not familiar with this).  If that is the case, then all you'd have to do is ask what is required to obtain this waiver for a judge to sign, by asking the circuit clerk of the county in which you reside it (or want to be married in).  He/She would be able to tell you the steps you need to go through in order to do this.  Again, I'm not even sure if there is such a thing, mostly if it's required by law that you must wait the 30 days, then that's what you must do, is wait until that period is up.  I'd definitely urge you check into this though.
