Hallmark Removal from Jewelry: Value & Refund Rights

I recently purchased a 1910 diamond and pink saphire ring set in rose gold.  It was at the time of choosing hallmarked which identified its gold purity and the date.  On having this ring re-sized they have removed the entire hallmark.  Does this take away the value and can I legally request to have my money back.  Would I also be within my rights to request a full refund in the instance that they suggest a credit note.  I hope this is something you can answer for me.

It depends on the type of hallmark and the date. I may have lowered the value or not.
You need to find an independent appraiser to examine the ring to determine this. The ring needs to be seen.
As for getting your money back it would depend on whether you had specific instructions to the jeweler or store not to remove the hall mark. Many times the only way that is inforceable is if you had it all written on the repair envelope and signed by both you and the jeweler.
It might not be a bad idea to check with an attorney if the appraiser finds a loss in value due to this. This would greatly depend on the value of the ring and the amount of the loss.
You may also need a past appraisal to prove that the hallmark was there before the jeweler sized it. Again, Check with an attorney.
