QuestionI am currently accruing stuent loan debt.
I have had three kidney transplants and am currently working on my masters degree so I may be financially better off in the future. I hope to be able to meet costly medical expenses (especially monthly medications) that I will have for the rest of my life.
I have met a wonderful man who wants to marry me. With my employee benefits from work and his employer health benefits, I would not have to worry so much about out of pocket medical expenses. I am afraid that if we marry, he will become legally liable for the debt I have accrued prior to marriage. I am referring to student loan debt. I do not want this burden on him. Can you tell me what the law says about this?
AnswerDear Lisa,
I am not a legal expert so I cannot say for sure, but it is my understanding that student loans, and any other debt that is not "comingled" after you marry, are solely the responsiblitity of the person who signed on the dotted line.
You could also draw up a prenuptial agreement and legal define that the student loan is yours to pay back.
You may want to speak with a financial expert to be sure.
