QuestionI ave been married for about 6 months now, and things between me and my husband just are not working out, we decided it was just better for us if we got divorced, but
see I had my parents permission to marry I am only 17, and Im not pregnant, but I was wondering when we get divorced, do my parents become my guardians once again or am I looked upon as an adult and legally on my own? Since he is no longer my guardian.
AnswerHi Megan~
In some states 17 is old enough to be emancipated and to make adult decisions on your own. And now that your married and out on your own. You should be able to get an annulment or even a divorce w/o having to consult or get the permission of the guardian/parent.
You can go to the circuit clerk of the court of the county that you reside in. They should be able to tell you the legal age at which you can get a divorce. Tell them your situation and if they don't know the answer, they should be able to point you into the right direction for an answer. Also an annulment might be cheaper and easier than a divorce. An annulment is saying that the marriage is null and void and didn't happen. If that's the route you wish to go. Another option might be to get the yellow pages and to call around to a few lawyers and ask what the legal age is that you're considered an adult. Most lawyers will offer a free consultation, some will give you the answer right over the phone (or the secretary might even be able to answer your question).
