Child Support & Remarriage in Indiana: What You Need to Know

Question
I live in Indiana and I recently got engaged and am planning to get married this summer. I have a 16 yr old at home and a freshman in college (I also have two other older children who are living on their own). I receive child support from my ex-husband for my two children and was wondering when I get married, will the amount that he now pays me change?

Answer
Hi Jana~

No, the amount will not change.  The state can't and doesn't go by your spouses income (no matter what he makes), period.  The only way he can get the CS amount lowered is if he gets takes a pay cut from his job and he makes substantially less money than what he did before.  Then he could take it back to court and ask for a reduction in his CS amount.  But the amount that your impending spouse makes has absolutely nothing to do with your income amount and the amount of CS that you receive.  No worries.
