QuestionThe man that I'm marrying has children and the mother is a sucker for money (she's never satisfied), and I'm looking to protect myself. I'm attempting to draw the line financially before we get married and instead of using a lawyer, I was going to draw up a contract, let a Notary Public sign, along with my fiance, and two other witnesses. I would like to know if this would stand in court should the mother try to take us to court for more money. We will file our taxes separate also. We are all residents of Louisiana.
Thanks in advance for your reply.
AnswerHi Clee~
The ex-wife is not entitled to anything you have or own. That mean any income that you make, any property, etc. The only money, etc that she could try and go after would be any income that the ex-husband makes (i.e wages). For example~If he got a raise at work. She could take him to court and have the child support raised. That is about all she can do. She's not entitled to any property that her ex-husband has or inherits, etc after the divorce is finalized.
I would say that the prenup agreement drawn up by a Notary of Public would be good enough. But you should just make absolutely sure that it'll be an accepted legal document by the courts if you should need it in the future. You can ask the circuit clerk of the court in your county,at your local court house. I hope this helps you some.
If you have any further questions please feel free to ask.
