Engagement Ring Return After Breakup: Legal Rights & Obligations
QuestionHello,
If an engagement is called off by the man, does he have any legal right or claim to ask for the engagement rings back? What would happen if the woman chooses not to return the rings?
Thank you.
AnswerDear Amy,
Generaly speaking, an engagement ring is a gift It is not legal requirement for marriage. Therefor, you would not be breaking any existing law by not returning the engagement ring. Where it can get a little "sticky" is when the ring is a family heirloom. In this case he may be able to take you to court (if you let it go that far) and demand that it is returned because it is "inheritance" so to speak.
I am not a lawyer so I cannot say for sure how would be handled in court.
I think theknot.com also addresses this issue.
I hope this helps.
