Legal Surrogacy in Delhi: Laws, Benefits & International Options

Duration of stay in Delhi after birth of baby

Medical Visa

Medical visa will be an appropriate visa category in such a situation. However, such visa will only be granted if following criteria are fulfilled:

• The couple is duly married and should have sustained at least for 2 years
• A letter from the Foreign Ministry of the country or from the Embassy of the Indian Foreign country should be enclosed with the Visa application that clearly states that the country recognizes surrogacy and the child born through the Indian surrogacy will be permitted to enter in the country as the biological child of the commencing intended parents.
• The couple will provide an undertaking that they would take care of the child born through Surrogacy.
• The program should be done only at one of the registered ART clinics recognized y ICMR.
• The couple should sign a duly notarized agreement between them and the prospective Indian surrogate mother.
